Terms and conditions

The agreement between you and us when you buy a book from this website.

Who you are dealing with

Section 43 of the Electronic Communications and Transactions Act requires an online seller to disclose the following before you buy.

In these terms, "we", "us" and "our" mean that entity. "You" means the person placing the order.

What these terms cover

These terms apply every time you buy anything from this website. By placing an order you confirm that you have read them, that you are at least 18 years old or have the permission of a parent or guardian, and that the details you give us are correct.

Nothing in these terms limits any right you have under the Consumer Protection Act or any other law that cannot be contracted out of. Where these terms and that law conflict, the law wins.

Placing an order

Adding an item to your basket and completing the checkout form is an offer to buy. It is not yet a contract.

A contract comes into existence only when your payment has cleared and we have sent you an order confirmation email. Until then we may decline the order — for example if an item is out of stock, if a price was displayed incorrectly, or if we cannot verify the payment.

You do not need an account to buy. If you check out as a guest, your email address is how we identify your order, so please make sure it is correct.

Prices and VAT

  • All prices are in South African Rand.
  • Prices shown include VAT at the prevailing rate where we are registered for VAT.
  • Delivery is charged separately for print items and is shown before you pay.
  • We may change prices at any time, but never after your order is confirmed.

If a price is obviously wrong — a decimal point in the wrong place, for instance — we will tell you before taking payment and you may cancel without penalty. We will not hold you to an obvious error, and we ask that you do not hold us to one either.

Payment

Payment is taken by PayFast, a registered South African payment gateway. You are redirected to PayFast to pay and returned here afterwards.

We never see, handle or store your card number, CVV or banking credentials. Those go directly to PayFast over an encrypted connection. What we receive back from PayFast is a confirmation that a payment of a particular amount succeeded, and we verify that confirmation independently before releasing anything to you.

eBooks and audiobooks

When you buy a digital edition you are buying a personal licence to read or listen to it. You do not acquire the copyright.

You may:

  • download the file and keep it indefinitely
  • read or listen to it on any device you personally own
  • make a backup copy for your own use

You may not:

  • share, upload, resell or lend the file, in whole or in part
  • remove or alter any copyright notice
  • use extracts commercially or in training material without our written permission

Download links are personal to you, expire after a set period and allow a limited number of downloads. This is to prevent links being circulated, not to limit what you bought. If a link stops working, ask us or use your account and we will issue a fresh one at no charge.

Print books

Print editions are posted to the delivery address you give us. Despatch and delivery times, costs and areas served are set out in our delivery policy.

Risk in a print book passes to you on delivery. Ownership passes once we have received full payment.

Cancelling and returning

Your rights to cancel, return and be refunded are set out in full in our refunds policy, which forms part of these terms.

Availability and accuracy

We try to keep stock levels, descriptions and cover images accurate, but we do not warrant that everything on the site is free of error at every moment. If we cannot supply something you have paid for, we will refund you in full.

Intellectual property

The text, images, book content, design and code of this website belong to us or to our licensors and are protected by copyright. Buying a book does not transfer any of those rights to you beyond the personal licence described above.

Your account

If you create an account, you are responsible for keeping your password confidential and for anything done through your account. Tell us immediately if you think someone else has access to it. Changing your password signs out every other session, which is the fastest way to shut an intruder out.

Our liability

We are liable to you for loss that we cause you and that follows naturally from our breach of these terms. We are not liable for loss that was not reasonably foreseeable, for loss of profit or business, or for loss caused by circumstances outside our reasonable control — including a failure of the internet, of the payment gateway, or of the postal or courier network.

Nothing here excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that the law does not permit us to exclude. In particular, your rights under sections 55 and 56 of the Consumer Protection Act to goods that are safe, of good quality and free of defects are not affected.

If something goes wrong

If we cannot resolve it between us, you may refer the matter to the National Consumer Commission or to a recognised consumer goods ombud. You do not give up that right by agreeing to these terms.

Governing law

These terms are governed by the law of the Republic of South Africa, and the South African courts have jurisdiction.

Changes to these terms

We may update these terms. The version that applies to your order is the version published on the day you placed it, and the date it was last changed is shown at the top of this page.

We use only the cookies this site needs to work — your basket, your sign-in, and remembering this answer. We do not track you. Read the privacy policy.
